For an Ontario litigation partner reviewing an expert report, the useful question is what a material AI-assisted step contributed to the reasoning. A short methodology packet can connect that step to its source material, validation and the expert’s correction or acceptance. The result is a method another qualified reviewer can follow, with limitations visible before reliance. Across recurring technical reports, the same review structure can reveal repeated documentation gaps while preserving each expert’s independent judgment. It supplements the applicable reporting requirements; it does not decide whether the opinion is admissible. Ontario Rule 53.03 already requires an expert report to identify instructions, issues, opinions, reasons, factual assumptions, research and documents relied on, together with the expert's acknowledgment of duty. Recent amendments add source-authenticity and quotation-accuracy certifications in specified circumstances. Those requirements should not be converted into a blanket rule that every expert must disclose every software interaction. They do, however, make source integrity and method reconstruction especially important when AI materially influences what the expert reads, compares, calculates or writes.

1. Define the AI-Assisted Expert Question

The expert's task should be framed independently of the technology. What issue is the expert addressing, what specialized knowledge is required, and what facts or assumptions are being tested? This prevents the analysis from drifting toward whatever an AI tool happens to make easy. A clear question also helps distinguish research assistance from a method that materially shapes the opinion. Separate expert judgment from machine assistance Record where the expert made the substantive inference. If AI summarized documents, extracted features, translated material, generated code, searched literature or drafted language, note the role accurately.

2. Build a Source-Integrity Record

Verify authorities and research material Rule 53.03 now requires specified authenticity certifications for authorities, documents or records referred to in expert reports, subject to the rule's exceptions and presumptions. Verify quotations separately O. Reg. 275/26 added a signed certification addressing the accuracy of quotations from authorities, documents or records. That is a distinct control. A source can be authentic while a quotation is incomplete, altered or taken from the wrong version. Compare quoted text to the underlying source and keep the verification step separate from substantive agreement with the source.

3. Document Material AI Methodology

Capture what could affect reproducibility

If AI materially affects the expert's method, preserve the system identity, relevant version information, instructions or prompts that changed the analysis, source population, material parameters, output relied on, validation steps and expert corrections. The objective is not to preserve every keystroke. It is to let another qualified reviewer understand the path from inputs to the opinion and identify where human judgment entered.

4. Test the Method Before the Report Is Final

Challenge source and model dependence Ask what changes if a key source is removed, a model produces a different answer, a retrieval set changes or an assumption is wrong. An expert who can explain sensitivity and limitations is more defensible than one who presents a polished output as self-validating. Where appropriate, compare results against known examples, alternative methods or manual review.

Record rejected outputs and material corrections

A review trail should not contain only the answer that survived. If the expert discarded a machine suggestion because it was unsupported, inconsistent or outside scope, preserve a concise record when that rejection is material to methodology. This can demonstrate active expert judgment rather than passive acceptance of automated output.

5. Keep the Expert Role Independent

Do not let the system become the witness The expert remains responsible for the opinion. AI cannot sign Form 53, accept the expert's duty, answer cross-examination or justify a methodological choice.

6. Prepare for Challenge Without Overdisclosing

Create a controlled methodology packet

Build the methodology packet around the material step rather than the tool’s feature list. Link the source population, relevant system context, output relied on, validation performed, expert correction and remaining limitation. Record the technical reviewer’s question and its disposition. Keep the packet in the approved matter environment; counsel determines protection, discovery and disclosure, while the expert remains responsible for the opinion.

Illustrative exercise. A fictional expert uses an AI tool to compare technical records while preparing a report. The worksheet separates the tool’s function from the expert’s own opinion. Function. Describe the specific AI-assisted task and identify whether it materially influenced research, analysis or presentation of the opinion. Sources. List the consequential materials available to the tool, the reviewed source passages and any known exclusions or substitutions. Validation.
