New York AI Class Actions: Preserve the System State That Matters

A class-action practice leader needs to know which historical system can actually be examined before committing a team to a reconstruction exercise. Today’s demonstration may use the same product name but a different retrieval source or decision threshold. For New York federal teams, a historical-state coverage register turns that uncertainty into a practical decision: which periods have supporting records, which remain incomplete, and what technical work could resolve the gap. The useful result is a bounded examination plan, not a promise to recreate every past output. Federal preservation principles already address electronically stored information. Rule 37(e) focuses on ESI that should have been preserved in anticipation or conduct of litigation and is lost because reasonable steps were not taken, when it cannot be restored or replaced through additional discovery. The rule does not create a special AI archive requirement. It does, however, make reasonableness and recoverability central. For AI-related class actions, that means identifying which model, configuration and source-state records could become material before ordinary product evolution makes them unavailable.
1. Identify the AI Decision System at Issue
Do not preserve a corporation's entire AI estate because one feature is disputed. Identify the system that made, recommended, ranked, scored or informed the challenged decision, the business process it served, the affected period, and the populations or claims connected to it. This narrows preservation to the technology that can actually matter to class issues or merits.
Map human and automated handoffs
Class-wide allegations can oversimplify a mixed workflow. Record where the model generated a score or recommendation, where rules or thresholds converted that result into an action, and where human reviewers could override it. Those handoffs may be essential to understanding commonality, causation or variation without implying a legal conclusion.
2. Preserve Historical System State
Capture the model or service identifier, deployment or release information, material prompts or instructions, thresholds, feature flags, retrieval corpus, policy layer and configuration that could affect the challenged output. Not every setting matters. Focus on variables that changed the result or the decision path during the relevant period.
Preserve change history
A current screenshot cannot explain last year's system. Maintain release notes, change tickets, approval records, validation reports, rollback information and dates for material changes. If the platform is vendor-controlled, identify which historical records the organization can export and which remain dependent on the provider.
3. Connect Preservation to Rule 37(e)
Ask whether the ESI can be restored or replaced
When a record class is at risk of loss, document whether equivalent information exists elsewhere. A historical output may be recoverable from a decision database even if the original chat is gone; a model version may be documented by release artifacts even if the executable service cannot be restored. This matters because Rule 37(e) expressly considers whether lost ESI can be restored or replaced through additional discovery.
4. Preserve Representative Evidence Without Hiding Variation
Large systems produce enormous logs. Sampling may be necessary, but the method should be documented: population, period, strata, exclusions, randomization or selection rules, and quality checks. A convenience sample can hide rare but important failure modes. Preserve enough metadata to show how the sample relates to the full population. Keep exception records Overrides, complaints, appeals, manual corrections and edge cases can be more informative than average performance. Preserve them when relevant to the claims or defenses. They can show how the system behaved outside the normal path and whether human governance changed outcomes.
5. Separate Preservation From Merits
Do not turn a hold into an admission Preserving model records does not concede that the system was unlawful, biased, unreliable or causal. It keeps potentially relevant evidence available so those questions can be litigated on a factual record. The preservation notice and technical register should use neutral language and avoid premature substantive conclusions.
6. Build a Class-Action AI Register
Give counsel one reconstruction index For each disputed workflow, maintain system name, versions, relevant dates, decision purpose, source data, thresholds, human roles, vendor dependencies, validation artifacts, change history, retention location and legal-hold owner. Link each category to the claim, defense or discovery issue it may inform. This makes later production and expert work far more controlled. For a practice handling repeated AI-related matters, review that register at intake and at each material system change. Assign one technical owner to each unresolved period and keep the evidence supporting a version label alongside the label itself. A quarterly internal summary can show supported relevant periods divided by all identified relevant periods, together with unresolved vendor dependencies and their age. Keep matters separate and respect access restrictions. This is a coverage measure, not a reliability score: a well-documented period may still contain disputed conduct, while a missing executable may have useful alternative records. Repeated gaps then inform the next accepted verification scope rather than another open-ended reconstruction request.

FAQ
What practical problem does AI class-action preservation solve for legal teams?
AI class-action preservation matters when it changes a legal, operational, or evidentiary decision. Start with the actual workflow and consequence. Then choose controls proportionate to the matter.
Which authorities should counsel verify before relying on AI class-action preservation?
Start with binding law, court rules, professional duties, and contracts relevant to AI class-action preservation. Separate guidance from mandatory authority. Recheck time-sensitive requirements before relying on them.
Which records best explain AI class-action preservation if later challenged?
Preserve the sources, material outputs, versions, reviewers, approvals, and exceptions tied to AI class-action preservation. Keep the record proportionate. It should explain consequential decisions without collecting everything.
Where should human review occur within AI class-action preservation workflows today?
Human review should occur before AI class-action preservation affects advice, evidence, filings, or external action. The reviewer needs authority to correct or stop the process. Record material overrides.
How should vendors support AI class-action preservation without expanding unnecessary risk?
Technology supporting AI class-action preservation should fit the defined workflow and data sensitivity. Review access, retention, security, exports, and vendor dependencies. Do not treat architecture as a legal guarantee.
When does independent review add value for AI class-action preservation decisions?
Independent review helps when AI class-action preservation raises unresolved technical or evidentiary questions. Define a narrow mandate first. Keep legal conclusions with counsel and technical findings within verified limits.
Which misconception most often distorts decisions about AI class-action preservation today?
Do not assume one tool, log, metric, or control settles AI class-action preservation. Context and corroborating evidence still matter. State technical findings proportionately and preserve important limitations.
A practical worksheet
Illustrative exercise. A fictional class action concerns decisions spanning a retrieval-system update. The worksheet compares the relevant historical state with the current configuration without assuming causation. Function. Identify the challenged function and the period during which a model, threshold or retrieval change might matter to that function. State. Record available version identifiers, configuration records and source-population information, including evidence supporting when the change occurred. Coverage. Identify missing periods, known vendor limitations and alternative records that might establish context when full reconstruction is unavailable. Decision. Use the comparison to define the remaining technical question; a current demonstration should not silently stand in for evidence about historical operation.
